Tax Incentives and grants
· ACT 60 - INCENTIVES FOR INDIVIDUAL INVESTORS RELOCATED TO PUERTO RICO
o (Section 2022.01) Tax Exemption to Income Derived from Interest and Dividends Earned by a Resident Individual Investor.
o (Section 2022.02) Special Tax for Resident Individual Investors on Net Capital Gain.

· HOME BUYER ASSITANCE PROGRAM
o Applicants may qualify to receive financial assistance in the form of a grant towards purchasing a new or existing home. The Homebuyer Assistance Program grants up to a maximum of fifty-five thousand dollars ($55,000) to eligible households. Properties located in Urban Centers, as certified by PRDOH, may receive an additional five thousand dollars ($5,000) to be used towards the purchase price. Additionally, the Program benefits and improves homeownership opportunities to eligible Low-to-Moderate (LMI) and Urgent Need (UN) households. Assistance will be secured with restrictive conditions on the property for the CDBG-DR funds awarded for a five (5) year affordability period.

· RESURGE PROGRAM
o Relocation: Homes located in a one hundred (100) year floodplain or high hazard area (as identified in the environmental review), whose estimated cost of repair exceeds $60,000 or 50% of the current appraised value of the home, whichever is less, will qualify for relocation.The applicant may receive an offer to voluntarily purchase the affected property, along with a Relocation Voucher for the purchase of an existing replacement dwelling. If a suitable replacement option cannot be identified, eligible applicants may receive assistance for the construction of a Program-designed home on a new lot only as a last option. Who can benefit from these CDBG-DR funds from the ReSURge Program? Property owners in the municipalities of Guánica, Guayanilla, Lajas, Peñuelas, Ponce and Yauco that were substantially affected by the 2019-2020 earthquakes. They must meet the low- and moderate-income parameters, and any eligibility requirements, as stipulated in the guidelines.

· REGISTERING PROPERTIES IN THE SECTION 8 PROGRAM
o Homeowners can be landlords, as long as they meet the following requirements:
§ Provide evidence of property ownership (Copy of the deed)
§ ASUME Certification
§ Provide a Negative Criminal Background Certificate
o Landlord violations that may lead to contract termination:
§ Failure to comply with the terms of the contract
§ Having outstanding income tax debts
§ Failure to file tax returns in the past 5 years
§ Failure to maintain the property in optimal condition and to repair deficiencies found during inspections (Housing Quality Standard (HQS))
§ Making agreements outside of the contract for higher rent payments
§ Failure to provide requested evidence related to the property and/or official documents

· INCENTIVES FOR BUSINESS ENGAGED IN TOURIST ACTIVITIES
o (Section 2051.01) - Tourist Activity means: (1) the ownership or administration of: (i) Hotels, including the operation of Casinos, Condo Hotels, Puerto Rican Paradores, Agri-Lodgings, Guest Houses, Timeshares and Vacation Clubs, lodgings that participate in the “Posadas de Puerto Rico” program, certified as Bed and Breakfast (B&B), and any other lodgings that, from time to time, participate in the programs promoted by the Tourism Office.
o (Section 2052.01) - The Tourist Development Income derived from Exempt Businesses that hold a Decree under this Chapter shall be subject to a preferential flat tax rate of four percent (4%) in lieu of any other income tax, if any, provided by the Puerto Rico Internal Revenue Code or any other law.
o (Section 2052.02) - Any Property Devoted to a Tourist Activity shall enjoy up to a seventy-five percent (75%) exemption on all municipal and state taxes on real and personal property.
o (Section 2052.03) - A New Exempt Business and an Existing Tourism Business that is an Exempt Business shall enjoy up to a fifty percent (50%) exemption on license fees, excise taxes, and other municipal taxes on its Tourist Development Income, transactions, events, or on use, imposed by any ordinance of any municipality.
o (Section 2052.04) - Exempt Businesses shall enjoy up to a one hundred percent (100%) exemption from the taxes imposed under Subtitles C, D, and DDD of the Puerto Rico Internal Revenue Code with respect to those items acquired and used by an Exempt Business relating to a Tourist Activity.
o (Section 2052.05) - All Exempt Businesses and their contractors or subcontractors shall enjoy up to a seventy-five percent (75%) exemption on any tax, levy, fee, license, excise tax, rate, or charge for the construction of works to be devoted to a Tourist Activity within a municipality, imposed by any ordinance of any municipality, as of the date prescribed on the Decree.
o (Section 2052.06) - Oil by-products (excluding residual No. 6 fuel oil or bunker C) and any other hydrocarbon blend (including propane and natural gases) used as fuel by an Exempt Business under this Chapter to generate electric power or thermal power used by the Exempt Business in connection to a Tourist Activity, shall be completely exempt from taxes under Sections 3020.07 and 3020.07A of the Puerto Rico Internal Revenue Code.

· TAX EXEMPTION APPLICABLE TO INCOME FROM RESIDENTIAL PROPERTY RENT – FILED STATUS
o P.S 1323 - Section 2 of Law 132-2010, as amended, better known as the “Real Estate Market Stimulus Act,” aims to extend the term of the tax exemption applicable to income earned from residential property rent from fifteen (15) years to twenty (20) years and to set a new deadline of December 31, 2030.
